Municipal Court Violations We Handle

Traffic Violations

Speeding, careless driving, red light violations, and moving violations are all handled in municipal court. We fight to dismiss or reduce charges and keep points off your license.

Disorderly Persons Offenses

Disorderly conduct, simple assault, harassment, and petty theft fall under disorderly persons offenses in NJ, the equivalent of a misdemeanor. These create a criminal record. We fight hard to prevent that outcome.

Shoplifting / Petty Theft

Shoplifting charges under $200 are handled in municipal court. Even minor theft convictions appear on background checks. We work to secure conditional discharge or outright dismissal.

Drug Possession (Small Amounts)

Certain small-quantity CDS possession charges begin in municipal court. We challenge the legality of the search, contest the evidence, and pursue diversion programs where available.

Local Ordinance Violations

Noise complaints, trespassing, parking violations, and municipal code violations are municipal court matters. We resolve them efficiently to avoid fines and further proceedings.

Simple Assault / Harassment

Disorderly persons level assault and harassment charges can result in probation and a permanent record. We negotiate with prosecutors and pursue dismissal or conditional discharge programs.

Municipal Court: Frequently Asked Questions

What's the difference between a disorderly persons offense and an indictable crime?+
In New Jersey, disorderly persons offenses (DP) are handled in municipal court and are comparable to misdemeanors; they carry up to 6 months in jail and $1,000 in fines. Indictable crimes (felonies) are more serious and handled in Superior Court. Both create a criminal record.
Can a municipal court conviction be expunged?+
Yes. Most disorderly persons and petty disorderly persons convictions in NJ can be expunged after a waiting period (typically 5 years). We can advise you on expungement eligibility and handle the process for you.
Do I need to appear in municipal court myself?+
In many cases, no. For traffic violations and minor ordinance matters, we can appear entirely on your behalf. For disorderly persons charges, you may be required to appear, but we handle all the work. You just show up.
What is a conditional discharge in NJ?+
A conditional discharge is a diversion program available to first-time offenders for petty disorderly persons offenses (and certain drug offenses). You complete a probationary period and the charge is dismissed, keeping your record clean. We frequently pursue this for eligible clients.
Will a municipal court conviction show up on a background check?+
Disorderly persons and petty disorderly persons convictions do appear on criminal background checks. Traffic violations and ordinance violations do not appear as criminal matters but may appear on driving record checks. This is why we fight every charge. The stakes are real.
